I received an update from my Congressman on the case before the Supreme Court. Here is part of what he sent.
I hope that they are correct. Two years ago, the Supreme Court ruled that the Second Amendment to the Constitution protects an individual's right to possess guns in their home for self-defense in the District of Columbia vs. Heller case. The Heller ruling struck down a ban on handguns and trigger lock requirements for other guns in Washington, D.C. However, it only applied only to federal laws since D.C. is not considered an individual state. Five of the Justices that decided in favor of that ruling still sit on the bench.
The Court is now hearing arguments whether Second Amendment rights should be protected against State and city regulations in the McDonald vs. City of Chicago case, and from the questions posed by the Justices during oral arguments, many believe the Court may take this position. Such a ruling would overturn outright bans on handguns imposed by cities, such as those of the City of Chicago and its suburb of Oak Park, which have banned handguns for almost 30 years.
I believe that the right to bear arms as outlined in the Bill of Rights is fundamental, and should take precedence over state and city laws. I will continue to keep you informed as the Supreme Court deliberates this issue.
