The Obama administration's gun ban initiative met stiff resistance in the Wyoming state legislature on Friday. On Jan. 11, eight house representatives and two state senators submitted house bill HB0104 that would make it illegal for federal agents to arrest Wyoming residents who possess hardware such as semi-automatic rifles and related weapons accessories.

The Tenth Amendment, which is part of the Bill of Rights, was ratified on Dec. 1791 and states the constitution's "principle of federalism by providing that powers not granted to the federal government by the Constitution, nor prohibited to the States, are reserved to the States or the people". In 2012, Montana proposed similar legislation aimed at protecting its citizens' rights (as well as hunters' rights) to possess firearms.

I'm fairly certain the Feds would preempt it anyways. In my home state, medical marijuana (and now recreational pot as well) have been legal for a while, and though our state laws say that those dispensaries are above harm, the feds come through and shut them down now and again. I think in practice, the states' rights end where the federal statues begin

I think it will get to the point of the personal level soon, where we have to decide whether we want to risk being a criminal for hanging on to our firearms. Many people will choose to keep their weapons regardless of new laws!

I like the idea of a state making a statement, but keep in mind that a statement is all they are making. They are making it a states rights issue, and the issue of states having rights against the Federal Gov't was done away with back in the 1860's.

Yes, we folk in the south seem to have had that pont drummed into us from an early age and many of our public buildings and historic sites reinforce the issue daily with their bullet scars and gravestones.

At the end of the CW the Fed determined that THEY were the unit that decided what power was granted by the Constitution, not the state.

If certain folks higher up had not grown up as pot smoking fools California and Colorado would be swamped with DEA agents right now. As it happens, the Fed really does want a stoned and complaceint population. If the ATF decides to invade Wyoming and confiscate every firearm in the state they will do so as if there were no border there.

My great-grandparents were alive during the military occupation of the Reconstruction government after the CW. I have talked to them about the conditions, not just read the propogada. The south lived under martial law for a decade, and carry the status of a conquered colony ro this day, to insure they never attempted to secure their rights again or forgot the cost of "rebellion".
