Who came up with this stupid phrase and how did we ever come up with it's meaning??

This resulted in a class action law suit that spanned several years and involved a lot of lawyers. In fact, Abraham Lincoln was part of the case. That whole story of him walking six miles to return a book was a bunch of bunk. He actually walked that far to take a deposition from a cake expert who also happened to have a degree in gastronomy. Anyway. As part of the settlement the phrase was changed to, "You can't have your cake and eat it to" although the litigants did not have to admit any guilt on their part.
