Here's one in Indiana that was tried and convicted for providing a false address on his 4473 form.

Dang, I just learned something. Look at the bottom (I put it in bold type.) were it tells about the purchase permit.

I had no idea, that's where it came from.

    North Carolina
To acquire a handgun in North Carolina (including private sales, gifts, and inheritance) an individual must go to the county sheriff's office in the county in which they reside and obtain a pistol purchase permit. This is not required if one has a CHP (Concealed Handgun Permit) permit.[232] State law requires the applicant to appear in person with government ID, pay a $5 fee, undergo a background check similar in scope and scrutiny to NICS, and have a reason for owning a pistol (hunting, target shooting, self defense, or collecting). Because there are 100 different counties in North Carolina, there are different sets of rules and requirements for obtaining such a permit, which can be determined arbitrarily by the local sheriff. Some sheriffs impose other restrictions such as a limit on the number of permits applied for at a time, waiting periods, and/or proof of good moral character (a witness or references, in some cases notarized with affidavits).[233][234][235][236][237] The Pistol Purchase requirements are a holdover from Jim Crow laws that were designed to prevent African-Americans and other minorities from easily obtaining handguns.[238]

Well, one just got a 3 year sentence. That should restore some faith in the system.

Rick, the question is on the form, but you can lie and still walk out with your gun. What I was saying, is that the mental part of it is not included in the called in check, that can stop you from taking possion of the gun.

You may well be right and I understand your intent on that. I don't know one way or the other.

Maybe Ken knows the latest numbers better Rick, but I remember reading 4 or 5 years ago that it was less then 1% nationwide that ever gets prosecuted.

Doesn't the Brady Bill require an active background check actually occur prior to the purchase? That includes being judged mentally defective. I know in some states prior checks or a CCW can be used to pass the check.

I've been a criminal defense lawyer for 26 years, and I've never represented nor even heard of anyone charged with making false statements on a firearms license or firearms purchase application.

The solution is really simple, and it doesn't "violate" doctor-patient privacy rights. Mental health professionals should be required to notify the government of patients with mental conditions which preclude firearms ownership. Such reporting requirements are already in place with respect to driver's licenses. Medical providers must provide notice of individuals who suffers from seizures or blindness.

Although considered "private" matters, mental health issues are raised and/or adjudicated in open court everyday. In Massachusetts, anyone who offers a guilty plea is asked by the judge, in open court, if he/she (currently or in the past) suffers from a mental illness.

In Maine, I have to fill out the form for every gun everytime. My CC permit has nothing to do with buying them, only carrying them here.

Well,, perhaps you all have missed the point. If we ban people, then there will be nobody doing bad things, or driving those nasty 18 wheelers. Sheesh, 2D I would have thought you of all people would have figured that out

there is not a weapon in existence more powerful than the human mind. all the laws wont do a thing if somebody plans on doing harm another person. the laws will just give a warm fuzzy feeling until it's obvious death is knocking on the door.
