    Default Water Rights

    I was looking at a thread for vertical gardening and came across something called Colorado water law. It stated that all rain that falls must be allowed to flow to rivers and streams.

    In other words no rain barrels.

    Can they not allow you to gather the water that falls on your roof? This sounds like the beginning of a bad thing.

    Do other states have this law?

    In Colorado the rain belongs to the state, all of it. Water rights there are diffcult to say the least. all water must flow into the watershed to be distributed to the senior right holders first.
    The law was recently changed so people who have no other means to procure water on there land may be giving the right to collect rain water.

    I have a feeling that law is to prevent large scale collection and/or diversion ,, what if it rains in your swimming pool ? are you expected to drain it ? lol

    That's almost as bad as what they do in Fall River, MA. There, they have a "RAIN TAX." That's right, they actually charge you a fee, based on the square footage of your roof and paved surfaces, for the storm water runoff that the city has to process in its system.

    I knew from a previous discussion that rainwater collection was illegal in Colorado. It seems it is also illegal in Utah. http://www.rainwatercollecting.com/blog/?p=56

    There was a thread quite some time ago where someone stated they would not allowed to collect water in any way. I don't remember if it was Colorado but one of the western states.

    They sort of did that already with the new health care bill. All tanning salons had a tax levied the day after it passed.

    You also have to pay if you're using water from a river or stream to generate electricity with a water wheel! The water compnies class it as abstraction and charge you per litre you divert even though it goes back into the system!!

    What really gets my goat is then the water companies encourage you to collect rainwater to use in your grden.... I can see another tax on the horizon.

    It happens everywhere. We are encouraged to conserve this, or use less of that in order to promote a better whatever. So we do. We use less water. Revenues decrease for the water company, so their rates go up. We use less electricity, same thing happens - rates go up. We buy more fuel efficient vehicles and use less gasoline - tax revenue from gasoline goes down. Now several places are looking at charging a tax based on mileage.

    I never thought of it like that Crash. Food for thought indeed. And it's funny you mention water rates going up, my annual bill has just gone up by £50.

    Colorado is where the water rights issues began over 100 years ago. It is very complicated and made sense to someone at sometime. But to a newcomer, it is frustrating and confusing.

    We have ridiculous laws here, too. For example, if we dig a well, we have to put a meter on in and pay the water company for the use.
