New Montana Gun Law

I was rather surprised to receive this information in an email. Apparently Montana has passed into law a bill which basically tells the Federal government to take a hike on any firearms laws that the Feds would try to enforce if the firearms/firearms accessories were exclusively made, sold and owned in Montana. Montana is basing this on the (apparent) legal basis of all Federal firearms laws which are constituted under the Commerce Act. Since there is no inter-state commerce but only intra-state commerce involved in these conditions, the Feds have to keep hands off (that means BATF has no jurisdiction). Interesting...

I've been followingi this. Some other states may join in with similar laws, which will in turn almost guarantee a Supreme Court review. Some Constitutional scholars feel it will pass as the court is currently constituted.

Where was the metal used to manufacture the gun mined? (I'm not kidding here.)

Is it likely that the firearm will cross state lines regardless of the declarations in the Montana law?

Will the firearm be transported on Montana highways built in whole or in part with federal funds?

Does this law serve as a mechanism to evade federal firearms/ammunition taxes?

I can think of hundreds of other ways the Feds could attack this legislation. Honest.

Will the federal government attach a rider to some piece of legislation in order to withhold any and all federal funds from states (i.e. Montana) which permit the use of silencers, the manufacture of firearms without serial numbers, etc?

The Feds will also take away matching highway funds, things like that, to force the state back into line.

We have a long history of being strong armed by the Feds. They threatened us with cutting of federal funding because we didn't have a speed limit, threatened us again because drinking alcohol and driving wasnt illegal (you could drink booze, and drive as long as you were in legal limits). Then really got mad at us, when our Governor was a loud outspoken critic of the Federal ID card, and said Montana would not participate in that. Our politicians are always trying to think of a way to iritate Washington DC

All the more reason that TDW and I have been seriously looking at Montana for retirement.
