need legal advice please

Hey, five months ago there was a fellow in my area that was accused of over 30 accounts of animal cruelty and neglect for mistreatment of sled dogs. Read the story here:http://www.bozemandailychronicle.com/articles/2008/05/14/news/20mushers.txt

The courts seized his dogs and put them up with foster families. I was asked to be a foster home for a few of these dogs- which I did.

When I got the dogs they were in horrible condition. Frail, under fed, un-socialized, and unkept. Also, although the dogs had great bloodlines they hadn't been exercized ever.

I took the dogs in, cleaned them up, stuffed them with food and water, than started training and conditioning them. Currently, they are at their ideal weight, well muscled, and have come along ways towards being socialized. In general very good young sled dogs with a promising future.

Now, the court has decided to give them to the guy who is accused of the neglect's father until the case is decided. The father lives in Maine and has a large sled dog kennel of his own.

The legal advice I need is what will happen if I don't return them? What can I do keep them out of the hands of this young man who neglected them. This is not a case of over zealous animal rights people charging in and busting a legitiamate enterprise. THis was fellow mushers in the area realizing that one of our own and not fed his dogs, or provided shelter for them in over a week- During a week it was 20 below zero, and over 3 feet of snow fell. What will happen if I am in contempt of court?

To my knowledge the father hasn't ever been charged with similar behaviour. And, nobody from the Montana court system has visited his kennel. This young man who is charged with the crimes- fled Fairbanks, Alaska because of over 18 outstanding warrants for him for animal neglect. He then showed up here, and within 3 months he was arrested for the same things.
My gut tells me, in this situation the apple doesn't fall far from the tree

That's what I thought originally when the court said the father could have them. But, now I have to turn them in by the end of this week.

Just tell him that you've bonded with the dogs and would like to give him some cash in place of them. I'm sure if this guy is willing to collect the dogs, he will have some heart to a fellow musher. Besides: extra $ upfront > $ lost in the long run feeding a lot of extra dogs

I agree with these guys. First research the father's place. Secondly, speak to the father and offer him money for the dogs due to your close bond with them, like Assassin said. Thirdly, if he is really intent on having the dogs brought to him, explain your situation and tell him that you would like just one favor and that is for him to not allow his son to have possession of these dogs again (of course if his repuation is a good one also).

Also you can contact the local animal rights center in his area and explain your situation. That way they can give this guy a visit to find out what his place is like. I'm not sure the legality behind reporting back to you on their visit, but I would assume that it's not too strict or too "fine-lined".

the prices of Alaskan Huskies vary widely. It depends on who the breeder is, who the parents, and grandparents of the dogs are, then it depends on the age/training of puppy/dog. $1,000 for a well bred dog from a top race kennel is a fair price. From a small time race kennel such as mine $300 (but my dogs are top bloodlines) for one of my dogs. To buy a well trained lead dog from a top kennel $3,000-$5,000. Most mushers have more time than money though- so they buy a couple of good dogs, then start breeding and training their own line.

Both Common Guy & Ken are right. I only take medical advice from a licensed Dr.. Likewise I would only take legal advice from a lawyer. Even a lawyer will tell you that they don't always know how a judge will rule. Let's look at what you've accomplished: You've nursed some very sick animals back to health as well as trained them. Even if you have to give them back then you've done way more than there previous owner has. Ken is a lawyer, & as a lawyer will tell you that EVERYONE in this country is innocent until proven guilty beyond a reasonable doubt in a court of law...and the previous owner's father seems to have a very good rep & no previous charges. Sorry to say but a "gut-feeling" is not admissable as evidence in a court of law. I also agree with most here that, since the father of the "accused perp" is in the "Dog-Raising business" that a potential attempt at a buisness negotiation should go farther than a "contempt-of-court citation". Also, if you go against the court you might be removing yourself from a list of qualified foster-care candidates who, in my opinion, need to be there for the next "abuse" case. Just a couple of pennies for you.:cool:

You have to ask yourself if you are willing to risk the wrath of the judicial system over a couple of animals. I know that sounds cruel but that's really what it boils down to. Let the dogs go. You've done a very good deed but it's time to say goodbye and good luck. Based only on this post, I wouldn't volunteer for that assignment again. By the way, I'm not being critical. There are a lot of folks that would become attached to the dogs.

If it is a court order - you will be in contempt of court if you don't turn them over.


I believe the only thing you can do is charge a high fee for your care.

Try to buy them, but first were you given any money for the care of the dogs? If not send the guy a bill for all the expenses such as food, cleaning and shelter costs, shots given, and so on, maybe that will work. I dunno, but just keeping them or giving them other dogs will end you up in a whole lot of hurt with the law.

It sounds like you got a $hitty deal, partner, but don't walk into a world of hurt with the legal system. Ken's a lawyer, he's the only one here that I know of, take his advice. My only advice regarding the legal system is avoid it if at all possible.

Ken--funny thing about all the people taking shots at you and your profession. Everyone seems to have all these nasties to say about lawyers until they need one. I'm pretty sure your profession is the same as any other, there's good and there's bad and there's mediocre.

I've been an Insurance salesman, a car salesman, and in school wanted to become a lawyer but didn't have the grades 'cause I was lazy & refused to study. Those, according to society, are the 3 "worse" occupations one can have...until you're hip-deep in poop, need a car, or have to pay a hospital bill or a funeral. I don't think your being critical. I pretty much decided I wouldn't do this again, after the court ruled the way they have. Honestly, I'm not attached to them- the way one would be to their pet. What's hard for me, is knowing that they're going back to a hellish situation. I feel more sorry for them than anything. I could give them up no problem- if I knew they were going to a decent place. I think anyone who ever saw these dogs or the conditions they had to live in couldn't help but to feel the same way. I actually believe that the young guy who owns them is mentally ill- not a cruel animal beater. He can't even take care of himself because of his illness, so obviously trying to take care of over 30 animals is going to be beyond him.
I met his dad today. His dad was very nice and thankful, and embarassed...however, he is blinded by a parents love. I do respect him though for trying to do the right thing, and take responsiblity for his sons actions. However, the dogs will go back to the son once this is all settled.

Goes though Internal Affairs investigation, outside investigation, desk-duty, surrenders badge and firearm, and experiences a lonely period when his friends stay far away. I've got a Cousin living in Lake Geneva, Wisconsin who's retired from the Force after 23 years. He was telling me how, when someone sued a cop, they sued the whole dept.. He'd lost count of the times he was sued, but never convicted! Gotta take the bad with the good I suppose. If I ever need a lawyer, and I'm innocent, I want Vincent Bugulosi. I read his books, ("And The Sea Will Tell" was awesome!) that guy's amazing! if I'm guilty I want OJ's "Dream Team", though J Cochran's gone.:rolleyes:

You have the right to petition the court for custody. You have bonded with the animals and they have bonded with your dogs. You offer them a good home and proper care. Ask that a court date be set on this matter before you release the animals to someone else.

This is a delaying action. It will be weeks before you have to be in court. If no one shows up to contest the request you have made, you win the case. Bring all the recorded records you can get as to their condition before you got them and a vet report on their present condition.

A good lawyer would be a help!
