I am moving to a place I bought 2 years ago, got it for a good price, freshened it up, rented it to friends for over a year, now I'm moving there because I'm tired of mowing 5 acres of grass all summer.
So anyways, here is the situation: Friends moved out and I finished remodeling the house. Built a new 12' X 16' shed, darn nice shed too. This house is in a very nice quiet neighborhood.
So shed had been there for 2 weeks, and I get this letter from a lawyer that says, please remove the shed in your back yard! Also in the envelope was an old letter from a neighborhood building committee date 1964. It stated that no separate structures are allowed to be built in this neighborhood.
Bear in mind that I have owned that house for 2 years and nobody has made me aware of any rules or bylaws.
There used to be a HOA but no meetings have been held for many years. Nobody has paid dues for many years as well. There basically is no HOA in existence! I checked the county building codes and no county or city permit is required for a building this size.
I have spoken to a few neighbors and none of the new residents have been informed of any rules, and the people that have been there for a while states that there is no HOA!
I have a feeling that the old Geezer that had that letter sent is just still trying to throw his weigh around, and apparently has no life. I will go to jail before I remove my building, and sue the Geezer for trying to enforce rules without informing new residents of said rules.
What is your take on this?

I would talk to a lawyer...just on principle......

My brother had the same thing happen...one guy complained...got reported ran afoul of some obscure rules.
Was able to modify the shed....with a fire wall...and put it up on blocks.

Guy that complained has a el-cheapo steel shed....MB was nice and even matched the siding.

Sooo....As a parting shot MB got a DNR wet land/prairie permit....so lets the low part grow wild so as to grow and blow dandelions, and other natural weeds.. ...
Guy complained to find out, "Tough bears, Bud...laws says NO MOW......"

Have you checked your deed to see if there is a clause in it that says your property is subject to the rules, regulations, and restrictions of "XYZ Homeowners Association?"

If it is not stated, and if you are still forced to move the shed, then you might have a suit against the title or escrow company that failed to include the clause in your deed.

Just guessing. I ain't no lawyer.

Check the deed for the clause for HOA or other restrictions . Whether its there or no contact the Lawyer and ask for a copy of the HOA's Bylaws ,Charter and copy of the last meetings Minutes . This will tell you when it was last active , the area involved and if it was dissolved . If it wasn't dissolved it will also tell you how to call a meeting to dissolve it . The nice thing is requesting that documentation should be under discovery and the lawyer should have to provide it .
One last thought . Age of lawyer and does he happen to live in the neighborhood ?

Yep, get a lawyer.

9 times out of 10 when you find an inactive HOA your problem is one homeowner with no authority, they will not be fulfilling their end of the contract and you can sue them for lack of services.

Drive around the neighborhood with a camera and document all the violations that are being ignored, and find out who the AH is that is causing you the problem. They like to work anonymously and lose a lot of arrogance when you know who they are.

I once lived in a gated community with more regulations than you could keep up with. TPTB constantly drove around inspecting every board brought home or birdhouse built.

I applied to the council for permission to build a fence. There were no stipulations to the height of the fence and I proceeded to put up a 10 foot tall stockade wall around my house. One of the primary busy bodies went ballistic and sat in front of my place taking pictures and jotting notes in a book.

He finally showed up the the zoning commissioner and asked what I though I was doing. I replied that I was tired of nosy people watching every move I made and passing judgment on the brand of hot dogs I was grilling. Zoning guy laughed and told him there was no county law regarding fence height and went home.

The harassment went on for a bout a week and I finally filed stalking charges on the head of the HOA.

Who did the lawyer say he represented in the letter? Usually, if the letter carried any weight it would be stated what that weight is.

Lawyers don't have any authority. It is a building official of some sort or the HOA. Municipalities usually use building officials such as code enforcement to make contact on violations. They should cite the exact code reference that you are violating.


Just a letter from a lawyer would get ignored by me. Until something else showed up that had some bite.

Nothing attached to the deed! The letter stated two residents names that were supposedly the building commitee! They are both Geezers and apparently trying to hang on to some kind of authority they use to have when the hoa was still active, 20 years ago!

Last night I spoke to a lady down the street that built a shed. She got a lawyer and was told by her lawyer yo just ignore them, there is no HOA!

If necessary I'll get in touch with her lawyer since she has already done the leg work! I hope those geezers come to my door! I'm going to verbally unload on them, and afterwards, tell them yo get off my property!

I would probably just tell them that I am getting right on it! When/if they come back..."I am getting right on it!"
I would also look at one of the residents yard, and then write a letter saying he has to change something...and then make it look like it was sent from the other guy. Then I would do the same to the other guy. That would keep them busy for a while.

I am getting in touch with the neighbor ladies lawyer as soon as possible. And if these guys persist, I will sue them for failure to inform, or something like that! The lazy A-holes sit around and do nothing, then hassle people that builds a perfectly nice building in their back yards!!
The building is very tasteful colors and blends in very well with the neighborhood, and am going to landscape around it in the spring! I wish they were younger so I could kick their azzes!!!

Why are you getting worked up? If you don't have an HOA or other covenants then don't worry about it. Why bother telling them off? If they come to the door then just say, "hang on a second". Close the door then go watch television. After a while they will get the hint and leave. If you want to check with a lawyer then do so. Just don't let it get to you.
