You should be sure to read 18 U.S. Code § 922 as you have the chance but the relevant part is:


(r) It shall be unlawful for any person to assemble from imported parts any semiautomatic rifle or any shotgun which is identical to any rifle or shotgun prohibited from importation under section 925(d)(3) of this chapter (https://www.law.cornell.edu/uscode/text/18/lii:usc:t:18:s:925:d:3)as not being particularly suitable for or readily adaptable to sporting purposes except that this subsection shall not apply to— (1) the assembly of any such rifle or shotgun for sale or distribution by a licensed manufacturer to the United States or any department or agency thereof or to any State or any department, agency, or political subdivision thereof; or

(2) the assembly of any such rifle or shotgun for the purposes of testing or experimentation authorized by the Attorney General.

because it's an imported firearm and in unmodified configuration, is a C&R [Curio and Relic] firearm. The moment you want to put a detachable magazine on it, you remove its C&R status and therefore 922r applies. That means you have to render "X" amount of parts to US made for it to be legal under the law.

The SKS makes a nice sorter swap too. I have the monte-carlo stock and a 5 shot magazine that makes a real nice deer rifle.

When dealing with an overreaching Federal government that has more LE subdivisions than any other country, there is no such thing as "not enough man-power." Federal officers are federal officers. All they need is a warrant and/or a Court order - Local or State police, DHS, US Marshal's service, FBI, US Park Rangers [Dept. of Interior], Port Authorities, US Customs [like Dept of Agriculture]...Hell....the FDA, a US Postal worker or IRS agent...they can pull resources from wherever they want and have all the man-power they need. I mean look what they did to Randy Weaver and how hard they came after him......and that man just wanted to be left alone......

Mostly correct, the exception being the part I rendered to red. The ruling is not "parts removed" - it's "No more than 10 imported parts"...which means that on any imported firearm that is made up of "X" amount of imported parts, you may only leave a grand total of 10 imported parts [as depicted on their 'lists'] - and you must replace the rest with US made parts. A mild distinction but relevant nonetheless.

In most SKS cases, you are correct. The stock and fore grips count as 3 parts and the magazines count as 2 parts for a total of 5 replaced parts. That would satisfy 922r because there would be 10 imported parts remaining on the firearm. In the case for my Yugo, I also had to either 1. replace the muzzle device with a US part [which is what I did] or 2. completely cut it off. I did not want to do that so, I got a US made flash hider and Jam nut.

The notation under the heading in the provided link says: "Please note that the as-imported configurations are compliant. This checklist becomes important whenever you wish to replace original parts on an imported rifle, or if you are building one from the ground up. The list of parts which 922(r) counts is:"

According to the list, the BATFE states that the SKS has 15 parts that are able to be changed to keep compliance. The "yes/no" column tells us if there are US made parts available. Change one and you must change 4 more to make that go from 15 to 10 to be 922r compliant.

Different firearms have different components and like was mentioned about the AK, there are actually 16 parts named for the AK.

Again [and I'm not saying this to cause any kind of drama] but the wording for 922r is very specific. To change a firearm from "stock" to "sporterized" or dare I say "tacticool", the "imported parts" count can not be more than 10. It has nothing to do with "how many US parts you can put on it." Druid, your law enforcement experience takes you directly into the path of local, state and federal LEO, which makes it appear there is one behind every bush. They aren't that plentiful in real life and they have other things to worry about.

Too much work for too little results for too few federal officers. The firearm being seized because of crime is (As KyRat pointed out) the only time it is enforced.

There is also a difference between a federal officer and a federal gov't employee. True, some employees are responsible for enforcing some laws, but not as an officer. For example, a postal worker has the responsibility for following through an incident of crime involving mail or an IRS person following through on someone committing tax crimes. These persons are not granted legal authority to enforce law as an officer. Then many who are an officer/agent are very limited in where they can function. Such as the federal park rangers. They have zero authority everywhere except on federal property under control of the USFS and the NPS. Outside of their area, then they have to cooperate with the local agencies and they don't have time or resources to fool with searching every semi auto firearm under the sun because they are contending with real issues.

Back to the OP (and I apologize for the side discussion although I have learned a few things from it), the SKS does look really nice. I prefer originals usually, but that looks really nice. One thing I might add to it is maybe duracoating the visible metal to a flat or semi flat black. The work that you have done is really good, though. I like it!

Yeah, I'm not going to belabor the explanation of the 922r ruling. I personally think it's idiotic but rules are rules. It wouldn't matter if I wanted to keep her stock.

I also said that no one has ever heard, much less reported about anyone going to prison for a stand alone charge of 922r non-compliance. I mentioned that it's usually an "add-on" charge to some other offense.

And I never implied that there was LE behind every bush. I merely said that the Federal government has much more resources at its disposal than the People want to believe. Just because "local" resources might be sparse to the casual observer, that doesn't mean they can't have a Platoon-sized strike force assembled in a matter of hours. I agree but make no mistake, departments don't care about getting sued because that's what insurance carriers are for. So long as we/they perform our/their duties "in good faith" and especially when following policy, nothing will ever come of it.

As far as "federal officer vs federal employee" - any federal employee has a little known clause in their job descriptions where they can be conscripted to any other department as needed. True the postman isn't LE but while actual LE has begun whatever they intend to engage, those not LE will get rudimentary training and fill in where needed. They get added to actual LE, primarily as a "show of force." Seen it....and it's really freaking scary. There's nothing worse than conducting Joint Ops with FBI, DHS, State Police, BATFE, our Locals and some bug-eyed records keeper who rarely sees sunlight from their dungeon in the basement...
It's not that they necessarily will do it - but that they could do it. Aside from my own job, it's always a bigger plus having a family member in the FBI, I get the skinny on so much crap it's ridiculous. This is why I fear for our Nation and her Citizens.

And thanks. I do like it more now than before. Hell, removing the stock took away a little more than half the weight of the rifle. The Tapco is only about 1/3 of the weight of the wood...but the Yugo barrel is so long, makes it a bit unwieldy. It's more front-heavy now and that will take some training to overcome that bit of a mess. On shorter rifle barrels though, this stock will do it much service.

And funny you mention the duracoating.....I actually visualized a flat dark brown, not black. From flash hider to the back of the dust cover, the trigger guard and bayonet. The bolt carrier I'd leave alone [don't want it flaking off into the receiver] and I thought about coating the magazines that brown as well. I think that'd look sick...

I have had some friends have encounters with law enforcement and firearms. I have had non-firearm federal charges.

Law enforcement always seems to default to trying to keep any gun regardless of the trial outcome. A lot of times where a serious crime did not occur. They plea out the best case they can and keep the guns.

I have had a Federal judge tell me that they do not care what the crime is. If the arresting Federal Officer can come up with a charge that the Federal Prosecutor is willing to risk their record to prosecute, she would allow it to go to trial. That is for my lawyer and the prosecutor to dispute.

I would bet any firearm EVER dis-assembled for any reason by any law enforcement agency was not put back together. That isn't how I have ever seen it work. All of the law enforcement agencies I have ever heard of that do a search, lawful or otherwise, do not ever put everything back the way they found it.

I have heard of plenty of cases of LEO's going to the wrong address for a search warrant. Breaking down the door and tossing the whole house. And then realizing the mistake and not even apologizing before going down the street and doing the same. You want them to put everything back? They won't even pay for the door unless you lawyer up.

I completely agree that it is very unlikely for an arrest solely on a 922r situation. But, I would always caution against rational reasoning from law enforcement. I could pull up dozens of internet conversations from LEOS on firearms where they very clearly state they do not care what your firearm rights are, what they think trumps your rights.
