View Full Version : Plastic Shopping Bag Breaks - Woman Dies - Husband Sues
I actually hope that this lawsuit succeeds. This one is NOT frivolous. These %#)&%!+ plastic shopping bags are WORTHLESS, and I've had more than one toe smashed when a bag broke and a can fell on my little piggies. The things break with the weight of two boxes of cereal, and retailers KNOW IT HAPPENS ALL THE TIME. A few $10 Million judgments will convince them to use better bags.
"The bag broke as she carried it to her car, the lawsuit says, and one of the cans fell on her right big toe, cutting and fracturing it. The injuries led to an infection that spread through her body and, despite antibiotics, hospitalizations and two surgical procedures, "ultimately resulted in her death on March 12, 2011."

If you can't figure out before you lift it that the bag is over packed or has something boxlike in it that is gonna tear it, your nanny state will take care of it for you. No worries.
I bring my own. Welllll.... I bring my own because it is easier than arguing about all the plastic bag trash that can't go in the recycling. If you could put them in recycling that would solve a lot of the problem.
Just buy a dozen and throw em in the trunk or back seat. There are signs now at most stores reminding you not to forget em. LOL. The MarketBasket blue fabric ones are nearly indestructible. One will hold six 2-liter bottles of soda without ripping. They're washable too, up to a point. Only my cats have been able to tear one. Not sure how. It's their favorite toy though.

$hit happens, and you can't always make someone else pay for it. (surprised they didn't go after the hospital as well for failing to save her)
I ask for double bags on heavy stuff and also bring my own. Since I schlep most of my stuff from store to home, I need bags with comfortable handles that won't cut into my palms like those plastic ones do.
So long as consumers are willing to accept less, they will get less. But they won't pay any less.
Still, this isn't a matter of preference or what's good for the environment. Retailers provide bags, as they have done for over a century. In their zeal to cut costs, most retailers are using cheap, weak, flimsy bags that they know often won't survive the trip back home. And then they overstuff them, knowing they will most likely break - after you leave the store.
In many cases, this means nothing more than a broken bottle or a damaged can. In some cases, people get hurt. The cost of the bags is included in the price that you pay for the products you've purchased. The bag itself is a defective product, and the retailer should be responsible for the foreseeable consequences of supplying defective products.

It wouldn't surprise me to find that the flimsy plastic shopping bags are the result of another law suit. There was a time when they weren't so flimsy, but they probably got sued for damaging the environment and had to use a thinner bag that would break down quicker.

We use the cloth bags as well as a insulated bag for frozen stuff........
When I do get plastic, I put a paper bag in the plastic bag.....make a good dog carp picking up bag.....

Seriously...bring. your. own. bags. It's not that big of a deal especially for those of you who drive to and from the store.
It doesn't take genius IQ to take a look at a plastic bag and take a guess if it's gonna hold or not. Ax for double or even triple bagging, if in doubt. I do.
So back to the jist of the question.....Did he win?

In reading the article I kinda gathered that....thought there might be some insight as to chances....
I would be interested to see how far it goes.....
Seems we hear about this stuff...then it get bogged down in courts for years, and the results are never reported, because of lack of interest of "Old News".

A lot of the problem with the bags is their recycled content. And probably reduced plasticizer.
Though I still think it's like blaming the pizza place for handing you a pizza so hot it burns the roof of your mouth. It's so hot you can't hold onto it but you bite into it anyway.
If you think this is the bag manufacturer's fault or the store clerk's fault, have at it.
But.
Did the woman ignore the small cut on her broken toe? How long?
Didn't we just have a post here about MRSA and feet and locker rooms?
I'd be more inclined to blame the hospital.
But.
The hospital doesn't do anything for broken toes, just paint them up if they're smashed, possibly hot-pin the toenail to relieve pressure under it, and tell you to take it easy and keep it clean. My dad used to break his toes all the time (he was a heavy equipment mechanic). He just used to soak his in epsom salts twice a day until the nail came off.
Ditto on BYOB (Bring Your Own Bag) and I'm not talking about the wife. I have cloth bags I take as well as a lightweight insulated bag for frozen foods.

We use our own canvass bags for most things, and dedicated HD nylon bags (washable) for meats.

EVEN BETTER, maybe they should sell everything out of barrels and we can bring in out own plastic bags and containers and fill them up in the store! I can see it now. Bring your own knife and have at it on a side of beef hanging in the meat room. Coax the chickens in the back room into laying eggs so you can fill up that carton. Churn your own butter! Milk a cow right into your own thermos bottle!
The possibilities are ENDLESS! Maybe they'll let me take a turn in the kitchen next time I go to the Capital Grille....
I have about 10 of the cloth bags. And three cars. And my schedule often doesn't lend itself to planned stops at the store. And of course, when I make a "fast stop for 2 things - and leave with 200 - the bags are inevitably in one of the other cars.
Regardless - if they supply bags, the damn bags ought to safely hold whatever they fill them with.

I've worked on equipment in a lot of restaurants, and won't eat in most of them........LOL.....Your own dishes might help a bit.....

I don't eat out a lot, but when I do I'm rather picky. If I've never been to a place I ask if I can walk into the kitchen. If they say no then I turn around and leave. The first restaurant I picked up for my business was an uber expensive French restaurant. The filth, roaches and rats in the kitchen made me want to puke.

Those flimsy plastic grocery bags when stripped into strips and braided make a half azzed cordage.
As a disclaimer I don't want to be held responsible if somebody makes up some cordage and goes rappelling with it or some such activity.

I went and checked a gas furnace awhile back due to no airflow. The young man had passed and his dad called me to fix the furnace. Apparently the young man had put a wood furnace in the garage and tied the ducts into the house ducts. He had stuffed the blower assembly full of those bags to stop the air from back drafting from the wood furnace and coming out through the gas furnace. He had it packed full.

When I lived in Poland and didn't have a car, I had to take the bus to the store. Most people in European cities don't drive to the store either, so the stores use heavy duty plastic bags. In fact, in some stores, they make you pay for the bags. So, most people brought their own cloth bags. I eventually got smart and bought a hiking backpack to take with me. I always made sure it was empty when I walked in. Some stores made me open it up for them to see what was inside, and most of them looked inside during checkout.
So what happens if they win big? My guess is three possible scenarios.
1. They start using heavy duty bags. And, they charge you for them.
2. They force you to use a cart to your car.
3. They put up signs saying that if you purchase items at their location, you agree to not sew them for stuff dropped on your foot.

I do my own oil because I want to use the oil I want to use. If I could bring my own oil, then I might let someone else do it.
I like shopping at Winco because they have barrels of bulk items that I can buy. I wish every store did that more.

Service call, Furnace not working......Got to house, plastic bag had gotten sucked into air intake, next to back door.......rang bell, pointed it out, pulled it out...by the time I got to basement, furnace limit had reset and was back running.....$89.95.
Service call, New construction, warranty, noisy blower.....plastic bag with remains of workers lunch stuffed in blower.......$89.95, plastic bag not factory installed OEM.

Those are awesome. I had a service call when I was a sprinkler tech, they said the system wasn't turning on. I got there, noticed it wasn't plugged into the wall. "Oh....that is what that plug was for". $60.
