While this isn't entirely new - the scope has changed dramatically. Initially there had to be a suspicion that at least the caller or the receiver was connected to terrorism an that the phone conversation was either initiated or to a foreign country. Then, within 72 hours of monitoring, a warrant from had to be obtained from the FISA court. If the warrant was denied, then surveillance stopped. Were there abuses? I'm sure there were.

The current process is to monitor everybody and everything to determine if they need to act. This is not only phone calls. It's also internet usage, banking, credit card usage.

I concur. As the president said, this is a game changer. I don't need the level of security they claim to provide. I don't want to give up my privacy for this. If reports are accurate then the government has collected trillions of data points and prevented one terrorist attack. I can only hope that this development leads to greater scrutiny and oversight of our intelligence programs. The parties who have stepped upon our constitutional protections in the development and implementation of these illegal programs need to be held accountable. They took an oath to protect and defend the Constitution from all enemies foreign and domestic. If this doesn't qualify as a domestic attack on our constitution, what does? Wherever the buck stops, politicians, judges, agency administrators, whoever could have stopped this and didn't. If we don't hold them personally responsible, you can bet the problem doesn't go away. It will likely just get buried under greater levels of classified protections.

Piers can't see the irony in his own reporting. What a putz! Most Americans, myself included, view the 2nd Amendment as our greatest protection against a tyrannical government. This story only reinforces the fact that governments can't be trusted to police themselves. If left to their own devices, they often tend to grow more oppressive. I don't know how we can ever hope to have an informed electorate when so much of what our government is really doing remains hidden behind claims of national security, state secrets, or executive privilege/order. Maybe it's time we review this whole need to know crap, a policy which results in ordinary citizens being denied the capacity to hold anyone accountable!

As I watch the damage control go full tilt in Washington today, I find myself amazed at the audacity of the people who have stepped forward to defend this illegal intrusion into our personal lives. This morning I caught Representative Peter King (R-NY) as he attempted to downplay the capabilities of these programs. He stands by the assertion that all that is being collected is the phone numbers, duration and location of these calls. Even if that were the case, which I don't believe to be the complete truth, if I'm not suspected of a crime there is no legitimacy for the collection of such information. He may be a fine congressman (I really haven't a clue) but he is either being intentionally misleading in his statements, or he a technological buffoon. You don't need a data collection center in Utah (with unknown Yottabytes of memory capacity) to store such superficial information. If I'm not mistaken, 1 Yottabyte is equal to 1000 trillion Gigabytes.

Far above and beyond the collection of call data is the capacity to capture every keystroke made on any computer, user histories, e-mails, video files, audio files, financial transactions, VoIP, and anything, I MEAN ANYTHING ever done online within the mythical privacy of your own home or office. Now if Congress had come before America and sought our approval for such an intrusion, that would be another story. But that never happened. How many other clandestine programs are out there today; secretly ignoring our constitutional protection against unreasonable search and seizure? Washington still doesn't get it. If Congress feels we can't be trusted with the truth, then maybe we should replace them with a Congress who remembers just who they are working for.

The official defense of this program is that this database has allowed federal agents to thwart acts of terrorism. OK, lets just surrender our 4th Amendment protections and trust big brother to have an observer's role in all our formerly private affairs. By the same extension of this logic think how many American lives we can save if we use clandestine programs to seize those evil weapons which are now protected by the second Amendment. After all the end justifies the means. Then, after we have "secured" the safety of all Americans, why not just install a permanent Government for greater continuity. Washington isn't listening to the will of the electorate anyway. In fact why don't we just shred the constitution and dismantle state governments. I mean with an all-knowing centralized dictatorship, state governments would just be an unnecessary redundancy. Finally a "safe" place to call home, Comrades.

Well, the whole lot of them just committed Treason. It isn't legal to circumvent the Constitution in a court. There's only one way to change the Constitution, by amendment. I really don't buy this defense, but so far it has been their justification for this program. I just don't see how collecting the volumes of data they're gathering on so many anonymous Americans doesn't violate the protections of the 4th Amendment. The kangaroo court that signed off on this needs to be brought before the nation and given it's own day in court. Politicians who are implicated in this need to be stripped of all federal benefits and brought up on charges as well. It is as if the whole lot executive, legislative and judicial have lost sight of their constitutional roles and forgotten their oaths of office.

Regarding Ken's post -- FDR's Executive Order 9066, interment of U.S. citizens of Japanese lineage.

Anyone here who has ever talked face-to-face with a Japanese American who was forced into one of the concentration camps?? I have. A couple of them when I lived in Los Angeles.

One was a woman about my age, living with a good buddy of mine in Santa Barbara. Among other things she told me of how harsh, how denigrating it was. I'll never forget when she spoke of her experiences at the concentration camp where she as a child, her siblings, mother and father were sent. Always guarded by soldiers with loaded rifles and machine guns.

In the conversation, something came up about "cold weather." She said, "You don't know what cold weather is until you spend a couple of winters living in a tar paper and plywood shack at Heart Mountain, Wyoming. We were from Southern California and did not have any winter clothes. Fuel was almost nonexistent and we were never warm. The goverment gave us almost nothing. They claimed it was due to the war shortages. That freezing Wyoming wind and snow never ceased. To this day I hate cold weather."

Later, her brother became a member of the 442 Reg. Cmbt. Team, the famous "Go For Broke" Japanese American unit. He was killed in Italy.

There is no doubt whatsoever that the "Government" will use any means it feels necessary to "control" the worker peasants. Witness what has been going on for years, and continues today in D.C., by our elected officials. The quest by power mad politicians and their sycophants never, ever ceases. It's just history in motion.

As I said in another post, Human Nature has never, ever changed: only Technology has changed.

I suppose [tentatively] that wikileaks, AT&T, etc planted the seeds of understanding in people about how we - at the federal level - conduct ourselves domestically in the post war on terror era. Let's be fair on the Japanese internment. While I don't agree that it was correct we were barely 2 months past the loss of 2400 men killed and another nearly 1300 wounded at Pearl Harbor. We had lost a large portion of our Pacific Fleet. We had lost the Philippines and Guam, Borneo, Hong Kong, Luzon and Wake Island and a U.S. naval base at Cavite. We are looking at history through an entirely different set of eyes.

It would be easy for an agency like the CIA to establish bogus investor accounts to avoid possible detection by regulators. You know I am still amazed by all of the efficiencies this age of computers has provided us. What I had never really considered, until now, was the growing potential for it's nefarious application.

General Alexander testified before Congress today and answered a number of questions related to the collection of metadata and PRISM in general.

"Alexander defended the bulk collection by saying it was necessary to give the NSA the widest possible data pool so it can then query the phone-records database for specific terrorist interaction with Americans. Once the NSA has "reasonable, articulable suspicions" of a person's suspected involvement in terrorism, Alexander said, "we can go backwards in time and see who he was talking to," and pass that information to the FBI.

"If you don't have that, how do you know who [a terrorist] was talking to?" Alexander told senator Mike Johanns, Republican of Nebraska, who worried that the database could lead to a "telephone records search for all of Omaha."

Well, it's actually pretty simple, General. You know when the call is in progress who the terrorist is talking to. That's the easy part. THEN you get a court order to acquire the suspect's information and or tap the phone. You don't have to have metadata on 15 million people to track one. Palease.
