A Demand For A Ban on 18-Wheeler's

While we're at it, may I suggest that a ban on 18-wheeler tractor trailers be included in these bills?

Thinking about it, I figure that maniac Loughner would have been far more effective if he had used an 18-wheeler. He wouldn't have had to stop and reload an 18-wheeler - he could even have backed up or driven in circles. An 18-wheeler would have been a far more effective weapon in a crowded Safeway parking lot, so reason would have it that 18-wheelers are more dangerous than handguns.

Such a law would be relatively easy to enforce, as carrying a concealed 18-wheeler would be rather difficult.

Of course, once we ban 18-wheelers, any ban on 10-wheelers, or pickup trucks, or cars, or even motorcycles would be out of the question. Right?

Just thinking....... some communities already require people to register their bicycles, don't they?

Because putting someones mental problems in a data base that can be checked, is considered a privacy violation, and is against the law!

I don't know if that is correct or not. I'm not challenging you, I'm just saying I don't know. The question of whether you have been judged mentally incompetent (I'm not certain of the actual wording) is certainly on the questionnaire when you purchase a weapon here in Indiana.

I may be kind of out of date on this stuff. Now that I have a CCP, when I buy a gun here, I have to fill out the paper, but they don't have to call in a background check....they just write in my permit number. The permit shows that I have been checked out. LOL

We have a 12 question (I think it's 12. Maybe 14) form that we have to answer. And the buyer has to fill it out. The dealer can't do it for you. It asks if you've been judged incompetent, been found quality of domestic abuse, have a restraining order currently against you and so on. Then the phone it in for authorization every time.

The biggest problem as I see it is that no one ever seems to get charged for answering falsely. If you lie to get your gun, you should be prosecuted. If you try to get a firearm when you are ineligible, you should be prosecuted. People will test the system just because there is no harm in getting turned down. If you try 20 times to buy a gun, you might slip though once, right?

I've been a criminal defense lawyer for 26 years, and I've never represented nor even heard of anyone charged with making false statements on a firearms license or firearms purchase application.

The solution is really simple, and it doesn't "violate" doctor-patient privacy rights. Mental health professionals should be required to notify the government of patients with mental conditions which preclude firearms ownership. Such reporting requirements are already in place with respect to driver's licenses. Medical providers must provide notice of individuals who suffers from seizures or blindness.

Although considered "private" matters, mental health issues are raised and/or adjudicated in open court everyday. In Massachusetts, anyone who offers a guilty plea is asked by the judge, in open court, if he/she (currently or in the past) suffers from a mental illness.

When I first began practicing, the program to "mainstream" individuals with mental illness was in full swing. This was clearly part of a liberal agenda to halt the "incarceration" and "stigmatization" of people with mental illness. Courts were releasing potentially violent patients at an amazing rate. Long-term inpatient mental health hospitals were closed down in favor of outpatient services.

The problem is, outpatient services simply don't work in many cases, and there's no system in place to require mental health patients to continue their treatment and stay on their medication. Only in the most severe cases, when individuals show clear signs that they pose an immediate risk to themselves or others, will a court order hospitalization, and, in most cases, the patient is released once their condition "stabilizes." And then the cycle begins over again.

I have a CCW and have a gun on my hip and I get turned down when I go to buy a gun. I have certain numbers and fax forms and I get my gun.

I come up as listed as an out of state fugitive from justice by the US Marshals office. I didn't pay the full fine on an arrest for spot lighting prohibited and a bench warrant was issued and Palm Beach county won't remove it from my record.LOL

Last night I picked up an SW 29-2 for a couple hundred bucks. No background check required.

Let's say that you suffer severe disabling depression(years ago) and require hospitalization, treatment, and therapy....say due to the loss of a loved one. This is something that you eventually come to terms with, even though at one time it gave you suicidal thoughts (Or possibly Homicidal thoughts, due to mis-diagnosis at a hospital of that same loved one, resulting in that loved ones death) Should you (Not someone else but you personally) in this set of circumstances be denied ownership of a firearm? Even though this was something that occurred many years ago?

Please do not just jump in with your answer, but think about that for a minute or two before answering.


On the other hand... what has been said about mental patients being released with no continuing follow up treatment or case worker to insure the treatment plan is followed is more common than many would think. Some homeless people are in this category. I met a few in this category when I was homeless. Forced discharge of mental patients is maybe more common than some would think or want to believe. The institutions can't hold them all as they are understaffed, under funded, and simply don't have adequate facilities.

Personally, I would be pretty soft on regulations.

Ya see....this is the problem with that type of gun control. Who makes these decisions? In the future, can these restrictions be taken too far. This is why I wanted to perhaps "Challenge" the way some people think of "Mental cases", Like lots of things there are exceptions. It's easy to quickly pass judgement on Joe Schmo from Kalamazoo, But a little different when some extenuating circumstances are applied to Ourselves, instead of someone we have no clue about.

The guy that shot the Congress woman, is pretty obviously "Out there" when you look at his Youtube site. But It is not always readily accessible information to things like the background check.

I'm sure that within an hour I could find SOMEONE that thought every one of us was "Whacko" for wanting to be prepared for unsavory circumstances. Some of us would be cited as OCD I'm sure. But does any "Mental Condition" preclude ownership of a firearm? All of us have them to one degree or another, it could be something as benign as a fear of clowns dressed in blue shoes and only at Circuses then. It could be a fear of spiders or heights. There are a broad spectrum of "Mental disorders" out there.

Some of us have them and would not think it right or fair that we should be denied ownership of a firearm. I mean if you are afraid of spiders in the extreme, then yes you MIGHT pull a .45 and blow away a granddaddy long legs or something along that line, but as a general rule we are all "Harmless, rational beings".

Probably about the same. Most - not all, but most - violent crimes are committed by teens and young adults. Maturity and hormone levels have a lot to do with it.

i expect the significant differences to fall between the occurrence of recidivism in specific crimes, rather than an arbitrary distinction between those of violent or non-violent natures.

a use of lethal force in defence against a percieved threat ruled to be unreasonable is probably less likely to result in recidivist behavior than say, an ideologically motivated and pre-meditated murder though both are violent in nature.

Poco, I guess that my point is this: We establish certain criteria to determine the likelihood that someone will re-offend or relapse. The criteria are established by experts and are based on statistics and studies and experience.

Are the criteria foolproof? Hell, no. However, in many cases, the alternative is life imprisonment or the death penalty for many criminal convictions. I dare say that if everyone who ever committed a crime were treated this way, there would be more people in prison that out.

Statistics PROVE that the prison population in the United States, in real numbers as well as in percentage of population, is the highest of any nation in the world. We incarcerate at the drop of a dime.

Accordingly, we have such things as parole and probation built into our system. Judges are given discretion in sentencing, based on facts made known to them.

Let one - JUST ONE - parolee committ a crime, and the general public wants to crucify the judge and the parole board. If a convicted felon serves his sentence and later re-offends, the public screams about the liberal criminal justice system's failure for not having imposed a longer sentence in the first instance. Sure, some judges are far too lenient - others are far too harsh. In my opinion, most try hard to be fair, and often operate with facts not known by the general public.

No system is perfect. With all of its failures, our criminal trial system is by far the best (even though it's deteriorating somewhat) in the world. However, our laws and sentencing practices leave a lot to be desired.

The biggest problem as I see it is that no one ever seems to get charged for answering falsely. If you lie to get your gun, you should be prosecuted. If you try to get a firearm when you are ineligible, you should be prosecuted. People will test the system just because there is no harm in getting turned down. If you try 20 times to buy a gun, you might slip though once, right?

Because that something represents a slippery slope...never mind that most things in life are a slippery slope. Something that should be navigated to the best of our human ability since it can never be eliminated.
Say, you're hurt in the middle of a remote nowhere and a slippery slope represents the only way to a possible help. By taking it you risk more injury but gain a chance to be rescued. By not taking it you risk expiring from your injuries before you get discovered.

Thinking about it, I figure that maniac Loughner would have been far more effective if he had used an 18-wheeler. He wouldn't have had to stop and reload an 18-wheeler - he could even have backed up or driven in circles. An 18-wheeler would have been a far more effective weapon in a crowded Safeway parking lot, so reason would have it that 18-wheelers are more dangerous than handguns.

Such a law would be relatively easy to enforce, as carrying a concealed 18-wheeler would be rather difficult.

Of course, once we ban 18-wheelers, any ban on 10-wheelers, or pickup trucks, or cars, or even motorcycles would be out of the question. Right?
