A few weeks ago a wild turkey showed up in our yard. It was not really a big deal other than the turkey was hanging out in the chicken yard eating the chickens feed. I really didn't care about the feed but the chickens wouldn't come out to eat, they were scared I reckon. My first instinct would be take matters in my own hands and be rid of the turkey but I'm suppose to be a upstanding member of society. Instead the wife called the local Dept of natural resources to see what to do. they laughed at her and done nothing and offered nothing. I don't need to concern myself because the turkey apparently "wandered" off. I know by now everybody is thinking a turkey, what's the big deal. the big deal is a person would probably get less time for shooting a county judge than shooting a turkey out of season. ok I may be exaggerating a bit but not by much. The bottom line is I have always taken care of what needs taking care of and I will never ever call the DNR for assistance again.

if the turkey is too scared to come around, or come around often then it won't be scaring your chickens much.

I don't advocate poaching except at need as a matter of personal life and wellbeing, but even then, You would have to accept the risk of legal consequences (including potential loss of your privilege of hunting and fishing in the future) and social backlash. Just because you perceived your situation to be an emergency doesn't mean a judge would agree, and does not mean your peers would support you. In a situation less serious, you could count even less on either.

I would poach a baby black rhino if it was to save my life, but I'd also have to accept the risk, all or none.

no rick that's not what i am saying. and further more it is not "poaching" if you are protecting your property.
you have to realize where we live. in the mountains. away from anyone there are only critters around here. if a bear raids my chicken coop destroying my time and investment what am i to do but protect it?
there were around a dozen or so bears (griz and black) killled by fwp this last year for getting into peoples chickens, cattle, etc..
there were also i a few dozen wolfs killed by fwp for the same reason.
many homeowners also killed wolfs and bears for the same reason.
there were a couple wolfs killed within or just outside missoula,mt city limits for killing and or trying to kill pets(missoula is about 1 1/2 hour from us).
you see things are different here. fwp kills dozens of these animals a year to protect private property. sure they try and relocate some but that usually dosen't work they return to there old ways, sometimes travling hundreds of miles right back to where they came from. sometimes there is no choice, whether it be fwp or a home/land owner these things have to be done.
a lot of time and money is invested in farm animals whether it be chicken,pig,rabbit, or cow. it is your personal property and must be protected.
just as if someone were trying to harm my family or property. it is no different. the end result is that you do what you have to do.
i do not need nor do i ask for 'premission'... to protect what is ours.

i am simply stating what MT law says; you have the right to protect yourself against man or beast. it's called the castle doctrine...

i don't have to worry. the closest human being around (besides my wife) is 9 1/2 miles away. and their are only three in that area. you can't even get here for months without a snowmachine. hell our mailbox is 13 mi away by a 2 room school house with 3 students.
and frankly i have never had to worry because we have never had problems.
we have had to chase a few bears away, both griz and black. they were just hanging around. we just send the hounds after them. after that they tend to stay away. a little old fashion hazing seems to work pretty good.
as have said before things are different here. i have NEVER heard of a case in MT where someone was tried for shooting an animal(man or beast) on his own property in defense of his property. again, it is called 'the castle doctrine' and it is in black and white. it is part of MT law. plan and simple.

Fresh out of wolves down here too, sadly. Haven't seen one since Idaho. Interestingly there, every time a sheep dies somebody tries to call it a wolf kill, even if it was 30 of them at once after they grazed over a stand of death camas. That always makes me shake my head. crafty wolves ;)

you got that right. the 'elevation mountain pack' has done a number up here along with the mountain lions (we are in what the blm calls a "mountain lion nursery"). they eliminated all cow tags last year because of low pop. due to predation.

The part of the situation that touched a nerve with me was the DNRs response. If I had shot the turkey and they got wind of it they would have showed up with their razor sunglasses, brush cuts and weapons drawn. we don't have conversation officers, they have become fish cops.

I am surprised that they didnt have better advice for you. Here, a warden probably would have showed up to verify you really had chickens. He would have probably told you then that it was okay to remove the offending animals. I guess every state is different.

Back to the Turkey...... I knew of a domestic Gobbler that would attack Any man. This Gobbler was hand raised by a woman and HATED men. It was not as "benign" as some would think. Think of a fighting cock on serious steroids!!! Just once I was attacked by that bird. From then on I didn't get out of the vehicle until it was penned up!!! Just the beating from the wings was like being in a fight with the fastest punching person you could even think of. Thank goodness he never connected with his claws! It did tear my jeans though. 3" rip in a split second.

Granted Wild Turkeys are fearful of humans and try to escape, but I can promise you if it wanted, those chickens would be dead if they tried to challenge the Turkey. Chickens usually aren't the brightest critters, but even they weren't stupid enough to challenge the Turkey. If they had they would be dead.

Perhaps if you tried a "live trap"? Maybe that way you could move it to another location. Matter of fact, why not suggest that to the DNR folks? Depending on the state they trap and relocate different "Problem Wildlife" all the time.

Here in Florida you can apply for a permit to take wildlife that is damaging your property or posing a threat to people, pets or livestock.

In this issue of woods and water they have a section on arrests by the FWC. A guy claimed deer were destroying crops and recieved a permit. The officers came by and examined his crops and there was no damage. The guy admitted to just trying to get a permit to kill a deer out of season. He got sited for several different violations.

In another state a friend had a very large bear eating his dogs food. He called the state wildlife officers and they told him that he could do nothing but secure his dogs and their food and hope the bear moved on.

He told them the bear was a threat to his dogs and the people on the property and if they didn't come and get the bear he was going to kill it. They told him they weren't going to do anything to the bear and neither was he or he would go to jail.

The bear didn't make it through the next day. The bear was estimated at over 600lbs.

Lord that ticks me off. When you call a department that is THERE to help out with nuisance animals and they LAUGH at you it REALLY makes me want to go down there and throw a fit.
At this point, however...they know you have an issue and you're kind of on a slippery slope. I think your only option is to find a way to keep the darn bird out, keep calling them until they get off their butts an DO something, or...get a bow. Honestly, I could care less if you kill the turkey, but I wouldn't be trying to make an argument that my chickens were scared of it so it was a threat. What was that South Park episode about the killer deer? LOL! It's a stretch is all I'm saying.

Michigan DNR laws are a joke. It's not so much the officer's fault who is left to enforce them as it is public opinion or perception thereof. There is very little science behind our laws or their enforcement.

Hunter harassment is a crime in Michigan, good luck making that one stick. And even better luck getting the judge or jury to pass down a just sentence if it ever did stick.

I would actually appreciate if the officers and staff had more boots in the field experinece and knowledge of the actual laws on the books, and knowledge of the areas and animals however. Most can't even tell a Fox from a grey squirrel or a coyote from a house dog. I hate to say that, but it's far and wide true. The further north in MI you head the more knowledgable and helpful the DNR is. but, I'm sure there are exceptions.

In my experience whenever an officer, or any other DNR employee, is asked a question they give their opinion on the matter which is quite often inconsistent with the actual law, but is based on how they or their boss feels about it. Or they try to side step the question and tell you to call someone else or seek help from an attorney, because it's illegal for them to give explanations of the law. LOL! OMG!

The fact is you could poach till your hearts content where I live and no one would ever know unless you were just plain stupid.

I am very much against poaching, not because of the laws, but because of the ethics and the knowledge that all game would disappear if it weren't for "ethical" hunters. Sure enough, we're not in Monatana, we got what seems like more people than critters and many abuse the law and have no ethics which results in no good hunting and fishing. The ones who abuse are the sport hunters and poachers who sell the meat.

all joking aside this issue is very important to me. when I was a kid turkeys in this area were rare, very very rare, I cannot emphasize that enough. I've been known as a wildman and scraping the edge of the law is one thing but messing with a rare species is another story. same way with badger, I caught one years ago and let it go. It was rare to see one at the time. hunters and trappers are leaders in conservation, more than people realize.

In some states you could have been prosecuted for "Harassing" wildlife, even if there weren't any wildlife there when you were greeted by the Conservation officer, who Could say that it had run off. For this reason I only use my Q-beam on the property and NEVER take it anywhere else. I have used it when Coyotes came on the property. A few months ago one of my neighbors had one of his cows attacked by a coyote. Almost killed the cow, yet amazingly the cow managed to get away.

Yes, I know a 20 pound gobbler is terrifying to some of you but I am sure you can squeel like a little girl and scare him away. If season was in you couldn't get within 100 yards of a gobbler, suddenly they are trying to come in the kitchen door.

ME: "Well operator, Lucile is qualified for "concealed carry."

OPERATOR: "I find all of this hard to believe sir!"

ME: "I don't blame you, last week a depressed, 600 pound bear showed up, grabbed my rifle, and before I could stop him, shot himself in the head! The other operator said that she had trouble believing that a bear would commit suicide like that!"

OPERATOR: "Well of course she would, so would I!"

ME: "I think the fact that the bear had emptied the rifle into various parts of it's body was why she had the problem....uh-oh!"

OPERATOR: "now what?"

ME: " Some Coyotes and wolves just showed up armed to the teeth! They're rival gangs and I'm afraid that they're going to kill each other! I'll get back to you...(Click!)

It all seems pretty funny until your chickens haven't been able to feed for a couple weeks. chasing it off didn't work, it would be back by the time I got back home from work. wild turkey in these parts were so rare a fella was lucky to see a couple a year. it took 30 years or better to even have a hunting season for turkey.

Well Randy, just use it as an opportunity to practice building a "Box trap", live trap it, and relocate it somewhere else. This would seem to be your only alternative with all things considered.

I remember when Turkeys were kinda' rare in S Ga.... One of my aunts had a flock near her house.(maybe in the '70's) She wouldn't even tell me where they were located to take pictures of.(I had never seen a wild turkey before) She kinda' protected that flock from everyone. Not sure, but I think she might have even took some of her chicken feed down there for them. It would have been like her, she thought the world of those Turkeys, None of the Hunters I knew, knew where any Wild Turkeys were either.

that's a good plan Poco. other than it is illegal trapping a game bird, says so in the game rules. maybe a guy could get a wink and a nod from the authorities to do this, I'm afraid to ask. don't want the system raining down on me. the dnr have more authority than the state police in michigan. I don't blame the turkey with a foot of snow on the ground a easy lunch is irresistible. It puts a honest man between a rock and hard spot. if we still had the old time conversation officers it would be easy peasy but instead we have academy kids with jack boots and a 40 cal. times have changed

Can you put up a natural predator without terrorizing the chickens? Maybe the silhouette of a crow or a plastic owl or hawk? Since you don't want to shoot or trap it that only leaves something like a predator to scare it away.

Randy, another thought came to mind. Can you put up some fencing around your feeder that the chickens can get in but the turkeys can't? Some slats or panels large enough for chickens might keep them out. They don't like to fly if they don't have to and probably won't go over the top.

Something we do to keep unwanted birds, like crows, blackbirds, and jays, from eating our peaches and pears is to hange a pie tin in the tree. I don't know why this works, but the noise and shiny seems to work. It might be worth a try.

Here in S GA the turkeys are making a comeback thanks to a lot of those wacky laws and CO enforcement. A few years ago it was pretty rare to see a flock of wild turkeys, and I haven't seen any this year in the regular places. I can only hope they've found new, safer grounds. There aren't very many turkey hunters here, but the few there are, certainly sound like they appreciate the recent law updates.

thanks for the thoughts. I was fixing to put a flight net over the top of the chicken fence but in the meantime the turkey went away. It isn't a issue now. it's not that I didn't want to trap or shoot it but do to so is illegal. I live at the end of a dead end road, it's very private here, getting caught breaking the law wasn't a concern but possible. I strive not to break the law. I felt with the DNRs response to my problem was the real problem.

Chickens aren't all that smart, wouldn't they get used to the turkey pretty quick? Or does it run them off? If it were me I think i'd end up with a new turkey. I had a huge wild flock running around but haven't seen any since I got my dog. :(
