Shopping out of state.

Went shopping at an Academy store, looking to spend my Christmas money.
Was looking at a Ruger lcr 38spl
Handles one a friend had kinda liked the light weight.

As I happen to be in Louisiana right now, I asked the guy at the counter how out of state laws read as far as hand guns.
I can't buy a hand gun here, and I'm told long guns resident of La. or bordering states only.

Now my question, and I know logic has nothing to do with it.
All hand gun sales go through a national data base for back ground check, what difference would it make?
I'm bummed.

While the database is national, the rules are set by each state.

I'm with ya, hunter. It's just plain stupid, in some cases. Some of Va.'s laws are because of NY throwing fits, saying that all their problems are because people buy guns in Va, and sell them/commit crimes with them in NY. I'm told that this is the reason that Va. now has a law that says you (residents) can only buy one handgun every thirty days.

I live near the state line, (Va/NC) and spend time in both states. I live in NC, and work in Va. Now, I have a CC permit (NC) and Va and NC honor each others permits, so it is legal for me to CC in Va.....but I can't buy a handgun there.(From a dealer,....private sales are.....well....private. LOL)

There is a proposal that would limit federal interference in things that don't involve interstate commerce.

I believe that all firearms purchase outside of your state of residence requires the transaction be made through an FFL and that delivery be made to an FFL in your state first.

You can not transfer ownership (give,sell or barter) of a firearm to a person who is not a resident of the state you live in. Doing so is a federal felony (27 CFR 478.147). You violate the gun control act of 1968 and risk a penalty of 5 years imprisonment and a fine up to $5,000. Even an FFL cannot sell you a gun with out violating this law. But, since the final transaction through an FFL in you state of residence constitutes the sale then you can have the firearm transferred to an FFL in your home state.

Same reason the online sites only transfer to FFLs.

It use to be not to long ago I could buy long guns from ffl dealers in ky and tenn, I'm from michigan. I would hang out at the gun shows down there and buy now and then, from ffl dealers not private parties. go back twenty or so years and the law wouldn't allow it. if I remember correctly it may have been in the mid nineties when it changed.

I didn't know the exact law, but I buy long guns in Va., I just can't buy a handgun there. (Unless I have it transfered to a NC dealer.)

I agree with the "fix it with your vote". line of thinking. If you don't vote, you have no reason to complain.
It seems that the 1st Amendment is being assuated in all sorts of different ways.

We all need to keep a close watch as the assult is not direct, just little bits here and there.

That's what I do if I find something I like and my local dealer doesn't have it. He charges $25 to transfer it to him (used to be just $20 dang it).

Living where I do I jump the state line into OH and IN and buy long guns legally, from FFL dealers, all the time.

I also have a small pawn shop owner here in KY that lets me use him as transfer power without notice for pistols. He gets a package with my name on it and just signs for it and lists it on his books, calls me to come pick it up. I pay him a flat 10% +state tax on the units. Due to having a CCW I do not have to get run through the BGC for the purchases. Keeps me legal and makes him a buck. He calls it his easy money.

It's sticking in my mind, that handguns have to be sent next day air. I want to say that's about $35. Add to that, around here at least, that shops want $25 to transfer long guns and $50 to transfer pistols. So for me to buy a pistol in Va, and transfer it to NC would cost me about $85 on top of the price of the gun. Also NC's sales tax is 2 or 3% higher than Va.

I ran into this when I was looking at a Romanian T-33 at a Va. gunshow. None of the NC guys had any. I wasn't willing to spend an extra $85+ on a $195 gun.

yeah, I happened to think of the shipping and transfer fee a little while after I posted that.
Here the transfer fee can be $40. Between FFLs I think they can go 2nd day. That's how my gunshop got in my target pistol. Probably every state is different on that too.
