Hypocrite Judges Ignore Their Own Outrageous Court Decision

The Supreme Judicial Court of the People's Republic of Massachusetts handed down yet another outrageous decision this past July - and 3 of the 7 Justices on the court apparently don't think it applies to them.

In the case of EMANUEL PAPADOPOULOS, et al, vs. TARGET CORPORATION, http://masscases.com/cases/sjc/457/457mass368.html the geniuses on our highest state court abolished a centuries-old rule of law and ruled that property owners are now liable for injuries caused by natural accumulations of snow and ice.

And here's the biggest rub: by law, property owners are ALSO responsible for slips and falls on snow and ice that occur on public sidewalks adjacent to their property.

What did this decision change? Up until this gem was handed down, property owners were only responsible for snow and ice conditions if they contributed to the condition, such as maintaining defective downspouts, directing water onto a sidewalk, piling snow up on a sidewalk, etc.

This thread is really about two things - the outrageous rule of law, and the fact that the judges who created it are ignoring it themselves on their own property.

There are so many things wrong with this decision...........

1. Why should any private party be legally responsible to maintain a public sidewalk or any other property they don't own?

2. The application is preposterous. The rule applies even in the middle of a major blizzard. The snow can still be falling and the wind can still be whipping, and if someone ignores obvious weather hazards and slips on your property or on the public sidewalk in front of your home, YOU ARE RESPONSIBLE!

3. Homes and commercial properties are treated the same. Isn't there a difference between your back stairs and the entrance to a mall the on the day after a snowstorm?

4. If a city or town snow plow repeatedly pushes snow onto a public sidewalk in front of your property, you are responsible to clean it up immediately, even if it happens at 3:00 in the morning. And where are you supposed to put that snow? It's illegal to shovel it back onto the road. How about buildings that abut the public sidewalk? There is no place to put the snow!

5. How about the sick and elderly and others who are not physically capable of shoveling? How about storms that occur when property owners are away?

6. How about the fact that your home is PRIVATE PROPERTY! Why should you be responsible, in the middle of a storm or in its immediate aftermath, for the safety of people that you haven't invited there, such as a door to door salesperson?

Isn't there a difference between a mall open for business 2 days after a storm compared to your front walk at 6:00 in the morning when the snow is still falling?

When we lived in Pottstown we were responsible for clearing and salting the sidewalk that ran in front of our house. One time we couldn't because we were all sick as dogs during a storm, and the police came to our door and informed us that if anyone fell and hurt themselves, we were liable! Needless to say we got our sick butts out there to dig out...

This new house, the boro wanted to bring sidewalks past our house. Needless to say I fought that tooth and nail. :creepy:
