Feds to step up enforcement

In the midst of an outcry over illegal immigration and Arizona's new crackdown, a top Department of Homeland Security official visiting Chicago on Wednesday said his agency intended to step up enforcement in places such as Illinois.

John Morton, who heads U.S. Immigration and Customs Enforcement, said his agency intends to expand the Secure Communities initiative, which gives police and sheriff's departments access to a Homeland Security database that includes fingerprints. The initiative recently grew to include most of Chicago's suburbs.

Morton, a former prosecutor, also said the agency intends to increase scrutiny of employers who knowingly hire illegal immigrants.

"If we're going to bring about meaningful changes in behavior, you have to do that by focusing on the employer," he said during a meeting with the Tribune editorial board.

Morton said the government's stepped-up enforcement would result in a "sharp increase" in deportations this year. Last year's 400,000 overall deportations were a record, but this year there has already been a 40 percent jump in deportations of criminals, he said.

Echoing comments by President Barack Obama and others in the administration, Morton said that Arizona's new law targeting illegal immigration is not "good government." The law makes it a crime to be in the state illegally and requires police to check suspects for immigration paperwork.

Morton said his agency will not necessarily process illegal immigrants referred to them by Arizona officials. The best way to reduce illegal immigration is through a comprehensive federal approach, not a patchwork of state laws, he said.

"I don't think the Arizona law, or laws like it, are the solution," Morton said.

There is a problem everywhere in the U.S. Not as bad as border towns, but problem's of their own.

That is a good place for someone from there, to try and make it look like the feds are doing something. It's a place they have control of, and will point to it, and say "see....we're doing our job, so just go back to sleep, and don't worry your little head about it." They don't want states doing for themselves. It takes power away from them.

I think the primary point he is making is that the "Process" used by the Arizona authorities is flawed and violates Federal Law. By processing "their " detainees, they are "taking a bite of the poisoned fruit". Ken can explain better than I, but it is essentially prosecutions made as a result of an unlawful action are generally unprosecutable, or at least very difficult.
I do believe they have read the law and that is what they are basing their / his decision on.

Correct, They are both "lawful" laws. If the suspect is apprehended by Federal authorities he is prosecuted for the Federal crime, if by local police for the state crime (with the obvious exception of the game playing done by prosecutors). The point being it has to be a "lawful" law. My contention is that the Arizona law is not "lawful". I guess the only way to really decide the whole issue is during the inevitable lawsuits when "innocents" like you or I are unlawfully asked for proof of citizenship by a municpal or State Police official (remembering that they do have the authority to ask you for proof of identity). If it makes anyone happy, I volunteer to be that first person, I have another retirement is coming soon and I could use the "windfall" cash award :)

You might be on to a money maker.....I'm no lawyer (Thank God!), but the way I read that law, they went out of their way, to be sure that someone can nail them, if they do wrong.
