    Default legal help

    if you file a report against someone and an investigation is to be don on them including an interview do they have access to your address? dose that depend on the state? because that's what i just did and the investigator said that after all my info was gathered and i am done with my interview the the person im reporting will have access to my address in the report. doesn't this go against common sense? i thought that there would be something in place to protect victims from there whereabouts and info being revealed especially from someone who has a history of violence. what do i do. who do i talk to to keep that from happening. if any of you have any advice pleas let me know. i know some of you have legal experience.

    Maybe Ken can chime in here. But as far as I know all information on a police report is public knowledge. Or at least available to the accused. My advice is talk to the proseutor or county attny. as well as the police detective handling the case. If the person you filed a complaint about is/has a violent history especially with law enforcement. Tell them that you are afraid for your safety, that if the person knows where you live/work that he/she will do you harm. Maybe a restaining/protective order will/can be issued. I don't see how/why they would release that information but.........

If all the mistakes I have made, let me give one person the wisdom that allows them to save their life or the life of a loved one in an emergency.     she was told but said she didnt know if anything can be don about it. the person im filing against has tried to locate me before (though a long time ago) but if my whereabouts are still of interest to him and its available he would be sure and take it. my thinking is that if some one was looking for you its not to do nothing when they find you.

    Owl Girl, police or investigative agencies in most states (my state of Massachusetts being one) will "redact" (remove or black out) sensitive or private information from copies of investigative reports given to a defendant/respondent. This is particularly true in cases involving reports of child abuse/neglect, rape and sexual assault crimes, and crimes of violence wherein the safety of a witness is likely in jeopardy.

    Have you actually given an interview, or have you made preliminary contact only with the investigator?

    If you are simply reporting your suspicions, you will probably not be called as a precipient witness, and you should be able to remain anonymous, unless your statements are used as part of an application for a search warrant which later comes under attack due to issues of truthfulness or probable cause.

    If the case you are asking about does go to trial, you can inform the police or prosecutor of your concerns ask the prosecutor to redact your information from copies of reports being given to the defendant/defense attorney.

    The defense attorney may then ask the court to order that he/she be given identifying information about you, for investigative purposes, but in many cases, even if the defense attorney is provided with such information, sensitive information such as your address, telephone number, etc. must be held as confidential by defense counsel and cannot be shared by the attorney with his/her client.

    I frequently receive sensitive information that, by court order, I cannot share with my criminal clients, including medical records, psychiatric records, telephone records, witness addresses, etc. Many states have laws or rules of discovery restricting the manner in which such information is disclosed.
