i think the tree is a maple

and does anyone know about eating it?:D

I think it's called a Jelly fungus here. Auricularia auricula-judae but I won't confirm it with only a picture. That doesn't look like a maple to me either. The bark is too smooth for maple and I can't tell what the leaves are supposed to look like. I see what appears to be an ivy growing in it.

Hello Laoch, It looks like a jews ear, or wood ear/ tree ear, however it also looks like a few other similiar non-edible fungus. It's really difficult to tell without having the thing in front of you and a good photographic reference book. The best one I've found is Roger Phillips Mushrooms.
However, I use the fact that wood ear favours elder, as a way of identifying it (a bit like how you stay safe with edible boletuses), the tree in the picture doesn't look like elder.
Even if your wood ear is the genuine article, personally, I wouldn't eat it, just to be on the safe side.
